These terms apply when you buy from La Casa Del Habano Windsor, 358 Ouellette Ave., Windsor, Ontario N9A 1A6 ("we", "us") through casadelhabano.ca. By placing an order you agree to them.
You must be 19 or older
We sell tobacco products, which in Ontario may only be sold to people 19 years of age or older. You must be 19 or older to use this site and to place an order.
We ask for your date of birth at checkout and check valid government-issued photo ID when you pick up your order or when it is delivered. We cancel any order when the buyer or the person receiving it cannot prove they are 19 or older. See how we verify age.
It is an offence to buy tobacco for anyone under 19. Orders placed for someone else who is under 19 will be cancelled.
Where we sell
Orders can be picked up at our store in Windsor or delivered to an address in Ontario. We do not ship to other provinces or territories, outside Canada, or to the United States. Details are in our Shipping Policy.
Products and prices
Prices are in Canadian dollars. HST and, for delivery, the delivery fee are added at checkout and shown before you place your order.
Product photographs are for reference: bands, boxes and packaging change between productions. Cigars are sold by the presentation listed (for example a box of 25), not loose unless the listing says so.
If an item is listed with a wrong price or description, we will contact you before processing the order and you may cancel it at no cost.
Orders and availability
Placing an order is an offer to buy. We accept it when we confirm it to you by email or phone. Until then we may decline it, for example if an item is no longer available, if we cannot verify your age, or if the order appears to be for resale.
Many of our cigars are limited or regional editions. If something you ordered is no longer available, we will tell you and either offer a replacement you approve or refund that item.
We may limit the quantity of any item per customer.
Payment
Payment is due before an order is handed over or dispatched. We take payment once we have confirmed your order; pickup orders can also be paid in store. Card payments are processed by our payment provider: we never see or store your full card number.
Orders that remain unpaid 7 days after we confirm them may be cancelled.

Health warning
Tobacco use is addictive and seriously harms your health and the health of those around you.
Liability
To the extent the law allows, our liability for any order is limited to the amount you paid for it. Nothing in these terms limits your rights under the Ontario Consumer Protection Act, 2002 or other consumer protection law.

Changes and governing law
We may update these terms. The version published when you place an order applies to that order. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
